Article 1.
Introduction.
1. eTOC Eikaiwa or online English conversation eTOC ("eTOC") provides English conversation services for English learners using communication software over an Internet connection ("communication software").
These Terms of Use govern the use of all services provided by eTOC on its website (hereinafter referred to as "the Service") by users of the Service (hereinafter referred to as "Members").
3. eTOC will do its utmost to make this service useful to its members.
4. Members are deemed to have accepted the Terms of Use by using the Service.
The scope of the Terms of Use shall apply to eTOC and its members, and the scope of the Terms of Use shall include the information provided on this site as well as information sent to members individually.
Article 3 Membership Registration Section 1
Prospective members shall register for membership in accordance with the procedures set forth by eTOC, and registration shall be completed upon notification of confirmation of payment of the admission fee and service usage fee by eTOC. In registering for this service, the member agrees to the following
1. You must read the Terms of Service carefully and accept its contents before registering for the Service.
2. The name, e-mail address, Skype ID, and other items provided in the member registration must be true and accurate.
3. Members should register after confirming that their communication environment does not interfere with the use of the service.
4. If the member is a minor, the consent of a legal representative such as a person with parental authority must be obtained.
5. To pay the usage fee by the payment method determined by eTOC.
Paragraph 2. However, if a member has acknowledged the reasons stipulated in this provision and has sent false information or committed any of the prohibited acts, etc. in Article 5, the member's registration may be cancelled.
Article 4 Privacy
1. eTOC obtains the minimum amount of information necessary to provide this service.
2. eTOC takes the utmost care to protect personal information obtained from members so that it is not used for purposes other than those for which eTOC operates. eTOC's privacy policy is explained in detail on this website.Privacy Policyfor more information.
3. Handling of Skype Name (Skype ID)
We will take necessary and appropriate measures to prevent leakage, loss, or damage of the personal information we handle and to safely manage other personal information. However, Skype names are public information that can be searched on Skype, etc., and information that is disclosed to tutors for the purpose of providing lessons. Therefore, it does not fall under the category of personal information that we take necessary and appropriate measures to protect and manage. The user will take reasonable and necessary precautions to protect and manage his/her personal information, such as creating a Skype name for receiving this service and registering it with the Company, instead of the Skype name used for private use.
Article 5 Prohibited Items 1: Legal violations
Members shall not engage in any of the following legal violations when using the Service
1. Infringing eTOC's intellectual property rights, including copyrights, trademarks, and portrait rights.
2. Any act that invades privacy, defamation, or fraud.
3. Other criminal acts or acts in violation of laws and regulations.
Section 2: Socially Inappropriate Conduct
Members must not engage in any of the following socially inappropriate activities when using the Service
1. Actions that are offensive to public order and morals.
2. Interfering with the operation of this service.
3. Actions that cause economic or emotional damage or disadvantage to other members who use the service.
4. Any activity that creates a financial interest with another member in a manner other than that approved by eTOC.
Harassing the tutor or interfering with the progress of the lesson. 6. Prying into the tutor's personal information more than necessary.
7. Any attempt by the Member or his/her representative to make personal contact with the tutor to the extent that it is deemed to interfere with the operation of the Service.
8. Other activities that eTOC deems socially inappropriate.
9. if there are no reservations for more than 2 weeks, the management may remove the reserved lesson slots from the schedule.
Article 6 Service Regulations Members shall agree in advance to and abide by the following service regulations.
Section 1 Use of Services
Members may use the service by paying the fee in the manner prescribed by eTOC on the site (bank transfer, credit card payment by Stripe, (some former eTOC students are on PayPal, but we are asking them to switch), or other remittance service). (Some former Eatock students are now using PayPal or other money transfer services).
Section 2: Service Updates
If a member does not cancel his/her membership in accordance with the prescribed procedure after paying the fee, it is assumed that the member intends to continue using the service, and the membership registration will be renewed at the same rate on the expiration date.
Section 3: Payment due date
If you do not continue to use the service (i.e., renewal procedure) by the expiration date in the manner prescribed by the Company, you will be deemed to have no intention of continuing to use the service, and the Company may, at its discretion, take the necessary procedures to cancel your membership. In such a case, the unexpired points will also be forfeited.
Section 4: Withdrawal Procedure
Members may cancel their membership in the prescribed manner. Members are required to notify eTOC of their intention to cancel their membership at least 5 days prior to the expiration date by logging in to "My Page" on the eTOC homepage and clicking on "Account Settings". eTOC will automatically reply to the member's request to cancel the membership via e-mail or other means. If you wish to register for this service again after canceling your membership, you will need to complete the registration process again.

If you cancel your membership, you will not be able to make reservations at that time and all points will be forfeited, including those with no expiration date. Please go to your account settings to report your withdrawal.
2. Upon withdrawal from the membership, the member loses all rights to the service. The member shall lose all rights and privileges related to the use of this service, and shall not acquire any claims against the Company upon withdrawal from the school. The Company may use the registration information for the Company's business, even after the user has withdrawn from the school, to the extent that the individual user cannot be identified.
3. The user acknowledges in advance that even if the user objects to any provision of this Agreement or any change in this Agreement, or objects to the contents of this service, the measures that the user can take against us are limited to terminating the use of this service and withdrawing from the school.
The Company may recommend that a user withdraw from membership. Users who are notified of the recommendation to withdraw from membership shall, without delay and of their own volition, complete the withdrawal procedures. Withdrawal due to a recommendation for withdrawal shall not be subject to this provision, and if an expiration date exists, the remaining number of days shall be refunded on a pro-rata basis. The Company shall transfer the amount of the withdrawal, minus bank charges and consumption tax, to the bank account in Japan designated by the user. If a user does not comply with the withdrawal recommendation, the Company may suspend or terminate the user's membership. In such cases, no refunds shall be made.
Section 5 Refunds
The Company will not provide refunds in the event that the use of this service is difficult due to a failure of the user's communication or computer environment, Internet connection or connection status, temporary difficulty in using the lessons due to the Company's system failure, or temporary difficulty in using the lessons due to the international Internet connection, political conditions in the Philippines, natural disasters, or Internet or system failure. No refunds will be made in the event that lessons are difficult to use due to international Internet connection, political situation in the Philippines, natural disasters, or Internet or system failures.
Section 6 Cooling-off
If you have taken the free trial, we did not force you to enroll, so the cooling-off period does not apply to you. For those who joined without having taken the free trial, we will accept your request within 2 days of joining. However, we will send the amount of the lesson fee (lesson unit price x number of lessons including gift tickets) and an administration fee (500 yen) deducted from the total amount of lessons already taken to your designated bank account.
Section 7: Change of Service
eTOC reserves the right to change the service, such as limiting the number of reservations or the number of people, in order to provide a smooth service to its members.
Section 8 Service Monitoring
eTOC monitors the services it provides in order to ensure the smooth provision of services to its members. Members agree and acknowledge in advance that sessions in which they participate may be monitored and recorded by eTOC.
*If there are no reservations for two weeks or more even though a homeroom lesson slot has been held, the management will remove the slot that has been held.
Section 9: Suspension or Termination of Service/ Refusal to Register for Renewal
(1) eTOC may suspend or terminate this service without the user's intention to continue using the service, and may terminate the contract without renewal. One month after the date of payment, (three months for the 3-month course), the indefinite ticket will be terminated simultaneously with this expiration date.
eTOC reserves the right to suspend this service in the event that it is difficult to provide this service due to reasons for which eTOC is not responsible, such as communication software failures, domestic or international political situations, natural disasters, etc. In such cases, eTOC will provide prior or subsequent notice on the site or by e-mail. In such a case, eTOC may give prior or subsequent notice on the website or by e-mail.
Section 10: Suspension or Termination of Service
eTOC reserves the right to suspend or terminate this service with prior or subsequent notice on the site or by e-mail. We also reserve the right to suspend this service in the event that it is difficult to provide this service due to reasons for which 810 is not responsible, such as communication software failures, domestic or international political situations, or natural disasters.
Section 11 Disclaimer of Warranty
1. Users expressly agree to use the Service at their own risk. We cannot guarantee the contents of the statements made by tutors, the contents of the service, the state of provision, the accessibility, or the state of use of the service. Users themselves are responsible for checking the contents of the Service with respect to authenticity, accuracy, accessibility, etc.
The Company does not guarantee the following
(1) Timely delivery of this service. Most tutors conduct lessons from home, so due to email delays, you may not be aware of your reservation within 2 hours.
Reservations of less than 2 hours can only be made if the user contacts the tutor in advance via chat and confirms with the tutor that the lesson can be scheduled.
Chatting with a tutor is available when you open all tutor pages in My Page. You can chat with all instructors by opening the All Instructors page for lesson reservations in My Page.
(2) Information that users obtain through the Service is accurate and reliable (i.e., complete, applicable, current, and useful, and does not contain information that may cause discomfort to users).
(3) A situation where lessons cannot be reserved due to a change in working hours or retirement of the desired instructor.
(4) If the instructor provides material different from your request during the lesson, the ticket will not be refunded if you report it after the lesson. Notification within 10 minutes of the start of the lesson is required.
(5) Situations where lessons cannot be reserved due to a change in the desired time slot or the working hours of the instructor or his/her resignation.
(6) Situation where you cannot reserve a lesson with a specific instructor.
(7) Power outages and communication problems in the Philippines force us to cancel lessons
(8) The Company makes no warranty of any kind with respect to products or services purchased on the Site.
(9) That the Service is free from any defects.
Article 7. Distribution of Information eTOC may send notifications, advertisements, surveys, etc. to its members either on the site or by e-mail. The eTOC will not use the personal information of the Member for advertising purposes.
Article 8 Use of Communication Software eTOC uses communication software (in principle, Skype and Zoom) to provide this service, and by using this service, the Member agrees to the following: 1, If you are unable to use this service due to problems with the internet communication software (including but not limited to audio interruptions, noise, or lessons in environments where the camera is not available), eTOC will not be held responsible for any problems. We will not be able to refund the ticket. Skype and Zoom are free tools. We are only able to offer this service at this price because of these tools. Of course, we know that they are not perfect, which is why we set the price low from the beginning. If you want perfection, we can't provide it. If you want it to be perfect, we will not be able to provide it.
2. eTOC shall not accept any inquiries regarding services provided by Internet Telecommunication Software. Article 9. Security eTOC uses SSL (Secure Socket Layer) technology on pages where members register their personal information on the eTOC website, so that even if a third party intercepts the transmitted or received data, there is little worry that the information will be stolen. The information is protected by a firewall (a system that protects against unauthorized access from outside), and we take every precaution to ensure that your personal information is not leaked to outside parties. We also use PayPal to register your credit card information, so you can rest assured that we will never know your credit card information.
Article 10 Changes to Terms of UseThese Terms of Use are subject to change without notice. Please refer to the latest Terms of Use at any time.
Article 11. Change of Registration Information Members shall change their registration information without delay if there is any change in the information they have provided to eTOC. eTOC shall not be liable for any disadvantages or other burdens incurred by members due to their failure to change their registration information.
Article 12. Personal Contact with TutorsContact with tutors in our services, whether online or offline, by users is prohibited. The Company will not be held responsible for any leakage of personal information that occurs as a result of personal contact with tutors. In addition, eTOC shall be liable to pay 1,000,000 yen per tutor to the member if any of the following situations occur as a result of personal contact with a tutor. This liability shall remain in effect even after the tutor withdraws from the membership.
1. any attempt by the individual or his/her representative to make personal contact with the Tutor, whether online or offline, including sending or receiving e-mails.
2. soliciting the instructor to work for a service or company that may be a competitor of our school.
3. to give one-on-one or any other form of English conversation lessons outside of our school.
4. if the tutor no longer works continuously due to 2.3. above, or if the tutor starts working continuously for a service or company that may be a competitor of ours.

Supplementary Provisions These Terms and Conditions will be effective as of September 30, 2023.
