Surety Work Co., Ltd. (hereinafter referred to as "Party A") hereby establishes the following terms and conditions that apply to all relationships between Party B (hereinafter referred to as "Users") and Party A regarding the use of all services (hereinafter referred to as "the Services") provided by Party A on "Hatten Eigo.com" (hereinafter referred to as "the Site") operated by Party A. By registering for the Services, Party B shall be deemed to have accepted these Terms of Use.
Article 1. Introduction
- hatten-english.com will provide English conversation services for English learners using communication software via internet lines (hereinafter referred to as "communication software").
- These Terms of Use apply to the use of all services (hereinafter referred to as "the Service") provided on sites operated by Hatten Eigo.com by all users of the Service (hereinafter referred to as "Members").
- HapptenEnglish.com will do its utmost to be of service to its members.
- By using this service, members shall be deemed to have accepted the Terms of Service.
Article 2 Scope of Terms of Use
These terms and conditions apply to Hatten English.com and its members. The scope of these terms and conditions includes information individually communicated by Hatten English.com to its members, in addition to what is stipulated on this site.
Article 3 Membership Registration
Section 1
Applicants shall complete membership registration according to the procedures established by Hatten English.com, and registration shall be deemed complete upon notification from Hatten English.com confirming receipt of the entrance fee and service usage fees. By registering for this service, members agree to the following:
- Read the Terms of Service carefully, and register for this service after agreeing to its contents.
- The phone number and email address fields required for member registration must be true and accurate.
- Members must confirm that their network environment does not hinder the use of this service before registering.
- If the member is a minor, obtain the consent of a legal representative such as a parent or guardian.
- Payment of the usage fee shall be made by the payment method prescribed by htten-english.com.
Term 2
However, if a member disseminates false information or engages in prohibited acts as defined in Article 5, etc., after acknowledging the grounds stipulated in these Terms and Conditions, their membership registration may be canceled.
Article 4 Privacy
- hatten-eigo.com will obtain the minimum necessary information from its members to provide our services.
- Hatten Eigo.com will take the utmost care to protect the personal information obtained from its members, ensuring it is not used for purposes other than the operation of eTOC. For more details on Hatten Eigo.com's approach to privacy, please refer to the privacy policy on this site.
Article 5 Prohibited Acts
Article 1: Illegal Acts
Members shall not engage in the following illegal acts when using this service.
- Acts that infringe on intellectual property rights such as copyright, trademark rights, and portrait rights of hatten-english.com.
- Acts that infringe on privacy, defamation, and fraud.
- Acts related to other crimes or acts that violate laws.
Section 2: Socially Inappropriate Conduct
Members must not engage in any of the following socially inappropriate activities when using the Service
- Acts contrary to public order and good morals.
- Actions that disrupt the operation of this service.
- Actions that cause economic or mental distress or disadvantage to other members using this service.
- Actions that create a financial interest between members in any way other than those approved by Hatten Eigo.com.
- Harassment of instructors or actions that disrupt the progress of lessons
- Prying excessively into a lecturer's personal information.
- An act of a member or their representative attempting to contact an instructor privately to an extent that it is deemed to hinder the operation of this service.
- In addition, actions that Hatten English.com deems socially inappropriate.
Article 6 Service Regulations
Members shall agree to and comply with the following service regulations in advance.
Section 1 Use of Services
Members can use this service by paying the usage fees stipulated on this website via bank transfer or Stripe (credit card payment).
Section 2: Service Updates
If a member does not cancel their subscription through the method prescribed by Hatten English.com after paying the usage fee, it will be considered as an intention to continue using the service, and the membership registration will be automatically renewed on the expiration date at the same fee.
3. Cancellation Procedure
Members can withdraw from membership by following the prescribed procedure. When a member expresses their intention to withdraw to hatten-english.com, and hatten-english.com notifies the member of their withdrawal via email, the member will be considered to have withdrawn. Upon withdrawal, the member will lose all rights to this service. If the member wishes to re-register for this service after withdrawal, they will need to go through the registration process again.
Item 4: Refund
Except for the cooling-off period stated in Article 5, HattenEnglish.com will not provide refunds to members. In the event that lesson utilization is temporarily difficult due to system failures on the HattenEnglish.com website, or due to international internet line issues, political unrest in the Philippines, natural disasters, or infrastructure failures such as the internet or systems, HattenEnglish.com will make its utmost effort to provide a remedy through services other than refunds.
5. Cooling-off Period
If you express your intention to cancel within two days from your membership registration date, as stated in item 3, we will refund the total amount of the enrollment fee and usage fees, minus a ¥500 administrative fee. However, if you have already used any lessons, you will be charged for the usage during that period (lesson price x number of lessons).
6. Service Hours
The operating hours for this service shall be as stated on this website, and Hatten English.com may change the service operating hours and days by posting notice on this website, either in advance or retroactively to members.
Section 7: Change of Service
Hattenenglish.com may make changes to services such as reservation and headcount restrictions, as long as these changes do not disadvantage members, in order to provide smooth service delivery to members.
Section 8 Service Monitoring
Happten English.com monitors the services provided to ensure smooth service delivery to members. Members shall agree and acknowledge in advance that sessions they participate in may be monitored by Happten English.com.
9. Service Interruption and Termination
Hatten Eigo.com may interrupt or terminate its services with prior or subsequent notice on its website or via email. Furthermore, if it becomes difficult to provide our services due to reasons beyond eTOC's responsibility, such as communication software malfunctions, domestic or international political situations, or natural disasters, we may interrupt our services.
Article 7 Information Distribution
Hatten-eigo.com may provide members with notifications, advertisements, surveys, etc., on the website or via email.
Article 8 Use of Communication Software
Hatten English.com provides its services using communication software (primarily Skype) and by using this service, members agree to the following terms.
- In the event that this service cannot be used due to malfunctions or improper settings of internet communication software or the communication equipment required for its use, or due to issues on the internet communication software side, Hatten English.com shall not be held responsible in any way.
- Inquiries regarding services provided by internet communication software will not be accepted.
Article 9 Security
On the "hatten-english.com" website, the page where members register personal information uses SSL (a system for encrypting and transmitting information over the internet) technology. Therefore, even if third parties intercept transmitted data, there is no need to worry about information being stolen. Furthermore, registered information is blocked by a firewall (a system that protects against unauthorized external access), and we take all possible precautions to prevent personal information from being leaked externally.
Article 10. Changes to Terms of Service
These Terms of Use are subject to change without notice. As we are unable to notify each member individually and obtain their consent, please refer to the latest Terms of Use at any time when using our services.
Article 11: Change of Registration Information
If there is a change in the registered information provided to Hatten English.com by a member, the member shall complete the registration information change procedure without delay, and Hatten English.com shall not be liable for any disadvantages or other burdens incurred by the member due to the member's failure to change the registered information.
Article 12. Governing Law and Jurisdiction
The governing law of these Terms and Conditions shall be Japanese law, and the exclusive jurisdiction for any disputes arising hereunder shall be the courts having jurisdiction over the location of our school.
Supplementary provisions: These terms and conditions will come into effect on May 31, 2023.
